1. Who we are
Healthy Joe’s is a trading name of Joseph Petherwick, sole trader. For data-protection purposes, Joseph Petherwick trading as Healthy Joe’s is the data controller where we decide why and how personal information is used.
Contact email: info@healthyjoes.com
2. Information we may collect
Depending on how you use Healthy Joe’s, we may process:
- your name, email address and other contact information you provide when you contact us;
- the contents of enquiries and other communications with us;
- information needed to discuss, arrange or deliver Personal Training or Bespoke Programme Design, including your goals, training history, available equipment and relevant circumstances;
- PAR-Q responses and other health or injury information that you provide for pre-exercise screening and safety administration;
- information connected with The Foundations, including purchase and account information, screening information and programme information held within My PT Hub where you choose or are required to provide it;
- purchase, payment-status, customer-service, cancellation and complaint records reasonably needed to administer a service or contract; and
- limited technical information generated when you use the website, such as information required for website security, hosting and strictly necessary cookies.
3. Why we use personal information
We may use personal information to:
- respond to enquiries and take steps at your request before entering into a contract;
- set up, administer and deliver Personal Training, Bespoke Programme Design, The Foundations or another Healthy Joe’s service you purchase;
- complete appropriate pre-exercise screening and administer health and safety requirements;
- process and record purchases, payments, cancellations and customer-service matters;
- maintain appropriate accounting, insurance and business records;
- protect the website, our services and our legal rights; and
- where relevant, evaluate and improve The Foundations using the limited programme information described in the customer terms and privacy information for that product.
Depending on the purpose, our lawful basis may be that processing is necessary to take steps at your request before entering into a contract, necessary to perform a contract, necessary to comply with a legal obligation, or necessary for our legitimate interests in operating and protecting Healthy Joe’s.
Health information is special-category personal data. Where we rely on explicit consent to process health information for pre-exercise screening and safety administration, we will request that consent separately. You may withdraw consent, although we may be unable to provide an exercise service if we can no longer lawfully process information needed for safe screening.
4. Email enquiries and marketing
If you email us, we will use the information you provide to respond to your enquiry and, where relevant, to take steps you request in relation to a service. We do not currently operate a marketing mailing list and we will not add you to a promotional email list simply because you contact or purchase from Healthy Joe’s.
5. Service providers and platforms
We may use service providers where reasonably necessary to operate the website, communicate with clients, process payments, deliver services, provide technical support or meet legal obligations. Depending on the service you use, these may include:
- Hostinger or other providers used to host and operate the Healthy Joe’s website;
- our email provider;
- payment or sales providers used to process a purchase;
- My PT Hub / Fitii Ltd where The Foundations or another service is delivered through that platform;
- communication providers such as Zoom or WhatsApp where you choose to use them for a consultation or discussion; and
- professional advisers, insurers, regulators or authorities where disclosure is reasonably necessary or legally required.
Some providers may act as processors on our behalf and some may act as independent controllers for processing they undertake for their own purposes. Their own privacy information may also apply when you use their services.
6. International processing
Some technology providers or their subprocessors may process information outside the UK. Where personal information is transferred internationally on our behalf, we expect the relevant provider arrangements to use an appropriate lawful transfer mechanism or safeguard where required.
7. Cookies and website analytics
We use cookies or similar technologies that are strictly necessary for security, functionality and operation of the website. We do not currently use non-essential advertising or analytics cookies. If that changes, we will update this notice and, where required, ask for consent before those technologies are used.
8. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, taking account of service administration, safety, accounting, insurance, legal obligations and the establishment or defence of legal claims. Different types of information may therefore be kept for different periods. Information that is no longer required should be deleted or anonymised in accordance with applicable law and the processes of the relevant service provider.
9. Your rights
Depending on the circumstances, UK data-protection law may give you rights including access, correction, erasure, restriction, objection, portability and withdrawal of consent where processing relies on consent.
To exercise a data-protection right, email info@healthyjoes.com. You also have the right to complain to the Information Commissioner's Office (ICO).
10. Changes to this Privacy Notice
We may update this Privacy Notice if our services, providers, website technology or legal obligations change. The current version will be available on this page and will show its revision date.
